[p.19] Fragments from a Register of the Bishop’s Curia: 1489-1492

Physical description of document

Although the registers housed at the Archbishop’s Curia, Floriana, do not go further back than 1545 or thereabouts, a fragment [1] which bears the dates 1489-1492 indicates that such curial registers existed since the closing years of the 1400s at least. The fragment consists of two sheets, which, when folded, make up four folios. The first two folios bear the date 1489, the second two 1492 – which means that a number of sheets or folios disappeared. The two folios are stitched together with half a sheet, which seems to have been taken away from a more recent register, for it contains entries dated 1519. The different entries have been reproduced in their entirety.

A word must be added on the transcription of some of the names which are included in the entries. The letter y is usually found after vowels in place of i. Especially interesting is its use after the letter l. Once the vowel i is employed as well after the same letter [gulianus, gilius], it seems that the writer or writers of the note, who apparently were the magister notarius and his staff, employed it to express the letter k. Hence CAUKI, though spelt CAULY, and SEYKIL, though written SEYLIL. In the text ly has sometimes been transcribed as it stands, sometimes as k. As for c followed by an h the following can be noted: It seems to represent a soft sound at the beginning of certain names [chilie, chuta], though apparently not always [chamie]. It expresses the same sound in the middle [cauchul] and at the end [bunich] of a word. But Michallef seems to have been written slightly differently; or to put it differently, the ch of that word, as that of xechibun and xechaberras, is written somewhat differently.

Editor’s comments on the contents

This fragment consists of 30 different entries some of which are incomplete and some relate to the same case. They can be classified under four [p.20] headings: (1) Injunctions, (2) Confiscations, (3) Guarantees, and (4) Declarations of intent.

Of the 14 injunctions all but one are prohibitory injunctions issued to married persons to stop seeing partners of the opposite sex outside their marriage; in three cases the injunction is also issued to the offending partner. In all they concern nine different cases, of which the following is typical:

Chuta the wife of Vestru Bartalu sive Seykil accused Giannella, widow of the late Antoni Spiteri, that she was holding her husband Vestru in ganeum, contra mandatum Sancte Matris Ecclesie, which means that she was having an illegitimate sexual affair with him contrary to the teachings of Holy Mother Church. Giannella was approached by the Curia and, under interrogation, declared in the affirmative, that she had been seeing Vestru Seykil - “se commisiste carnaliter cum dicto vestro tamen for sacamenti. Item interrogata si dictus Vester habet uxorem dictam chutam respondit Misser si.” This happened some time before the beginning of July 1489. A week later two injunctions were issued to Giannella, now referred to as ta cursile and to Vestru, respectively, prohibiting them to see each other - nullo modo audeat conversare seu praticare nec rem carnalem commistere - under pain of a fine of one uncia and a lashing also referred to as THE SHAME - sub pena frustigacionis seu la vergogna.

The other injunctions referred to (1) Gaspar Cadus, the husband of Ysmiralda and his innamorata Johanna, the daughter of Cataldu nicknamed midemmi, (2) Catherina, the daughter of Pietru nicknamed Gaydud, and her lover, the Honourable Francisco Calava who was married, (3) Giliu Fauczuni and his lover Zuna, the wife of Nardu Bunichi, (4) Symuni Felu and Cathirina figlia di lu micadin, (5) Johanna daughter of Garita di lu russu and Antunino Percop, (6) Catherina daughter of Andria Mifsud and Gulielmo Gaydud, who was married, (7) Paulu Bastianu who was married and Perna daughter of the late Paulu de Xechibun, (8) Perna wife of Georgi and Paulu the husband.of another woman, and (9) Lukina and Vestru Calfat. Thus there was one case in which both partners were married, three in which no mention of marital status of either is mentioned, and five in which only one of the offenders is said to have been married. Of the eight partners who are known to have been married, only two were women.

[p.21] The penalty was the same in most cases, namely as stated, a frustrigacio seu frusta seu vergogna and a fine of one uncia, with two exceptions where the fine was two uncie. In several instances it is stated that the money from the fine was to go to the Bishop’s mensa. The Bishop is identified as Cardinal de Fox, who according to Eubel, held the See of Malta between 6 July 1489 and 18 February 1491. In fact his name already appears on 1st July and does not appear at all in the 1492 entries.

The injunction relating to Giliu Fauczuni and to Zuna the wife of Nardu Bunichi is particularly interesting in one respect. It forbids Giliu from seeing Zuna de die nec de nocte nec cum ea habitare in eius spellunca. The reference to the cave - spelunca is a clear allusion to the local custom of cave-dwelling, the extent of which is not very well known. It is worth noting that most of these cases can be identified with inhabitants of Rabat if a comparison is made with two near-contemporary lists of the 1480s, namely a Rabat population list relating to wheat distribution and the Angara List of the 1480s. It appears from these that Cadus, Calava, Bastiano, and Xehibun were to be found solely in the Rabat/Dingli/Mdina area in the 1480s and furthermore, the Rabat list identifies a Gaspar Cadus cum duj altri bukj, a Vestru Seykil cum trj altrj bukj and a Nardu Bunichi cum quatru altrj bukj. The nickname Haydud was a Rabat nickname in the 1490s, lu Russu was found at Rabat in 1450, and Cursile occurs in the acts of Notary Zabbara of 1487, possibly also at Rabat.

Although a mere fragment, this document yields some interesting nicknames which include, further to the ones mentioned, tal micadin, il midemmi and chamie.

Another set of 11 records relate to the confiscation of goods from people indebted to some church official or who, for whatever reason, came under the jurisdiction of the Curia. Well-known Don Amatore Zammit had allegedly failed to pay 7 florins on a horse he had bought from Luca Farruge. Zammit refused to obey the mandatum execucionis in bonis and appealed.

In many cases the objects confiscated were items of clothing, clamis una di mustivileri vecha - an old cloak, una gunnella vecha nigra - an old black faldetta, una chmizi - a shirt, unu fustaynu - a length of fustian or coarse cloth. In other instances, unu paru di bertuli - two panniers, or seven sheep when the sum in question was somewhat heftier. In the case of Don Marco [p.22] de Bordino who was the main guarantor for his late relative Don Henrico de Bordino who still owed the Church the sum of more than two uncie that he had on loan, not only were his goods confiscated but he was evicted from the land at Curtin Errin on Gozo, whose lease he had inherited and he was arrested.

The debts concerned involved the sale of a quantity of must, the sale of Sicilian corn, payment of the cabella (qbiela) on Cathedral land, payment of dammagi (an impost on land), payment of ius servientis, and the sale of a quantity of cloth. All such registrations carried with them a statutory payment of one tari to the Curia and one grano to the notary.

The last set of registrations can be conveniently described as Declarations. Among these appears one by Paula alias sponsata (...) Haius, but a virgo intacta who wanted to join the Monastery of St Scholastica and profess in the Order of St Benedict. Having declared her intentions, the Vicar General gave her two months time in which to deliberate whether she really wanted to join or not.

Another case concerned Cesaria wife of Gulinu Baihr who had unfortunately been captured apud theucuros. Her brother Frankinu Caruana declared his intention to redeem her from captivity for which reason he needed permission to sell a stretch of land at il guardia, close to the shore-line at il chufra. Presumably he needed permission of the Curia because the Church had some interest in the land, such as that it carried some pious burthen, although this is not stated.

A third declaration concerns the Cleric Petru Debrancato who, on 18 July 1492, appeared before Canon Micheli de Fauczono, Vicar General of the Bishop of Malta, and renounced in favour of his friend and relative Don Antonio de Pidonie his animagium sive horatorium called ta kixiru, another animagium called ta bercax, and two warehouses in Mdina which were leased to the two Jews, Albium Sabbar and Chanen Inglixi.

Although fragmentary, this document sheds light on an important aspect of church bureaucracy in the late middle ages, supplying relevant details about people and events in the wider context of Maltese history with which it dovetails perfectly. Its importance is enhanced because of the dearth of similar records that have survived.
